1. Who you are contracting with

Gamsat Prep (the "Service") is operated by Perfect Health Pty Ltd ("we", "us", "our"), trading as Gamsat Prep at gamsatprep.com.au. By creating an account or continuing to use the Service you agree to these Terms & Conditions. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation. If you are using it as an individual, you confirm you are of legal age to form a binding contract.

2. What the Service is

Gamsat Prep provides GAMSAT exam-preparation materials, adaptive practice sets, timed mock exams, diagnostic analytics and an AI tutor that coaches your reasoning. The Service is an educational tool. It is not affiliated with, endorsed by, or connected to ACER or any body that administers the GAMSAT, and we make no guarantee of any particular exam outcome.

3. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Accounts are for a single individual; sharing an account is not permitted.

4. Acceptable use

You must not:

• use the Service for any unlawful purpose, or to commit fraud or send spam;
• infringe the intellectual property or other rights of any person;
• copy, scrape, bulk-download, resell, republish or redistribute questions, explanations, tutor output or any other content from the Service;
• interfere with the security or integrity of the Service, including introducing malware, probing or testing vulnerabilities, or circumventing access limits or rate limits;
• reverse engineer, decompile or attempt to derive the source of the Service.

5. AI features

The Service includes generative AI features. AI-generated explanations, hints and coaching may be inaccurate or incomplete and must not be relied on as medical, clinical, legal, financial or other professional advice. You are responsible for the prompts and content you submit, for verifying any output before relying on it, and for holding the rights to anything you input.

You must not use the AI features to generate illegal content, hateful or harassing content, malware, deceptive impersonations, or to attempt to jailbreak or extract underlying prompts or answer keys. We may filter, refuse, remove or restrict content and outputs, and may suspend accounts that misuse these features. If you believe content on the Service infringes your rights, contact us and we will review and, where appropriate, remove it; repeat infringement leads to account termination.

6. Intellectual property

We (and our licensors) retain all rights in the Service, including the software, question corpus, explanations, diagnostics, branding and documentation. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your own exam preparation. You retain ownership of content you submit and grant us a limited licence to host and process it solely to provide the Service to you.

7. Payment, subscriptions and taxes

Gamsat Prep is sold by Perfect Health Pty Ltd. Payments are processed by Stripe, which also handles tax calculation, collection and remittance, dispute handling and transaction-level billing support on our behalf where applicable. We never receive or store your card details.

Subscription payment, billing frequency, renewal, cancellation, tax and refund mechanics are governed by these Terms together with Stripe's consumer terms. Subscriptions renew automatically at the interval you selected until cancelled.

All prices are in Australian dollars: Pro Monthly A$69 per month, Exam Pass A$349 once for six months of access, Pro Annual A$499 per year, and the Full GAMSAT Paper A$49 as a single purchase. Prices are shown before any local taxes and are the current prices on our pricing page; we do not bill in US dollars.

8. Service availability

We aim to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free performance. Features may change, and maintenance or third-party outages may interrupt access. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time and cancel your subscription. On termination your access ends; you may request an export of your own progress data within 30 days, after which it may be deleted.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data, goodwill or exam results. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded under applicable law, including the Australian Consumer Law.

You indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

11. General

You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. These Terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction over any dispute. We may update these Terms; material changes will be notified in the app or by email.
